Guest booking terms and conditions
Please read these terms carefully as they make up your agreement with us. Deposits paid to confirm Bookings are non-refundable and cancellations are subject to the terms of each Park. You will have direct contact details for the Park in your Confirmation if you prefer to communicate directly, though we will be happy to assist with any requests to amend or cancel your booking.
In agreeing to use the Website to make Bookings you acknowledge that you have read and fully understood the following terms and conditions ("Terms") and that you expressly consent and agree to be bound by the Terms and all applicable laws and regulations that govern the Website.
These Terms are governed by the laws of England and Wales. If any provision of the Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Terms, which shall remain in full force and effect.

INTRODUCTION
Campsites.co.uk is a trading name of Addactive Limited (the "Company", "we", "our", "us"), registered in England with company number 05891444.
The Company provides an online platform ("Website", including www.campsites.co.uk and other websites and mobile apps) which enables you to reserve or book accommodation, make payments, or order other services as offered through the Website ("Bookings") from camping, glamping and touring parks ("Parks"). Booking payments ("Payments") conducted through the site are handled by a third party payment provider ("Payment Provider") and are subject to the terms and conditions of that third party.
These Terms govern the relationship between the Company and you, constituting a legally binding agreement ("Agreement"). By using the Website to make Bookings you acknowledge that you agree to and are subject to the Terms, and you consent to our use of your information in accordance with our Privacy Policy. If you do not agree to these Terms, which may be reasonably varied and amended at any time, you are not authorised to use the Website or the Booking service.
This Agreement is not assignable by you without our prior consent in writing.
GENERAL
RELATIONSHIP
The Company acts as an agent only in facilitating Bookings, but will provide support as a third party on a reasonable efforts basis in the event of any complaint or dispute between you and the Park. However, we cannot accept any liability in relation to any contract you enter into with Parks, or for any acts or omissions of Parks or other parties connected with any Booking that you make through the Website.
For all Bookings made or taken on your behalf through the Website, your contract is with the Park directly and will therefore be subject to their normal terms and conditions. Parks provide us with copies of their terms and conditions, which are displayed and require your acceptance during the Booking process, however we cannot accept liability for any inaccuracies, omissions or invalidities contained therein. The Company disclaims all liability arising from or related to Bookings to the fullest extent permitted by law.
Although we are not obliged to mediate between you and the Park in the event of any complaint or dispute, our reputation for customer service is important to us and we will make reasonable efforts to assist you and the Park in reaching a resolution wherever we can.

We cannot guarantee the accuracy of any information placed on the Website relating to Parks, their facilities, or the availability, type or prices of the accommodation they provide, or details relating to any other services they may provide ("Information"). The Information has been provided to us by Parks and is subject to change. None of this Information constitutes advice or recommendation given by us. We thereby disclaim liability for any inaccuracies relating to, the Information available on the Website. If you are unsure about any Information on the Website please contact us to confirm its accuracy.
In the event that, after making due enquiries of the Park, you have a complaint or objection to any of the Information posted on the Website, please contact us immediately using the details on our Contact Us page.
You acknowledge that although we make reasonable efforts to complete due diligence for Parks and check that they describe themselves accurately, they are solely responsible for abiding by all rules and regulations, including health and safety and insurance. We make no representations or warranties about the suitability of the accommodation and/or services made available through the Website. We will be under no liability whatsoever (whether in contract, tort or otherwise) in the event of you having a complaint relating the quality of the accommodation or other services provided by a Park, or in the event of suffering loss, personal injury, illness or death as a result of any act or omission of a Park, or their employees or agents. By using the Website, you agree that you will seek redress only against the Park who provided such service to you.
All Parks listed on the Website have committed to us that they will provide a high standard of customer care and we may take action if a Park falls short of the standards we expect.
PRICES, BOOKINGS, PAYMENTS & FEES
All prices quoted by Parks will include VAT if appropriate, at such rates prevailing at the time. Parks commit to matching their best rates in the prices quoted on our Website, but if you do notice any lower prices elsewhere please contact us using the details on our Contact Us page prior to your Booking and we will ask the Park to price match for you. Errors and omissions excepted.
By making a Booking you become responsible for making all Payments due under the Booking. A contract between you and the Park will exist when we receive the Deposit and send you a confirmation email ("Confirmation") on the Park's behalf. If you have not received a Confirmation within 24 hours of making the Booking please notify us as soon as possible using the details on our Contact Us page. Please check your Confirmation carefully and report any incorrect or incomplete information to us immediately.
You must be authorised to make the Booking by all persons named on the Booking (and by their parent or guardian for all party members who are under 18) at the point at which the Booking is made. By making the Booking, you are confirming that you are at least 18 years old and that all party members named on the Booking accept the Terms and you will inform the other party members of the confirmation details and any other appropriate information.
Payments will be collected according to the terms set by Parks and comprise a deposit amount ("Deposit") due at the point of agreeing Bookings and an optional second payment of the outstanding balance ("Balance Payment") as appropriate. Parks may require full payment at the time of Booking. If a Balance Payment is due, you authorise us to initiate collection of it as indicated to you during the Booking process and in the Confirmation email.
Except for our limited role in initiating Payments for Bookings, collection and processing of the Payments and forwarding the amounts due to the Park is managed by the Payment Provider. You acknowledge and agree that we have no involvement in that payment process. We will however use reasonable efforts to assist you in raising any payment related questions or concerns with the Park.
If the Park's terms for your Booking dictate that a Balance Payment should be collected automatically when it becomes due, we will instruct the Payment Provider to process that charge using the same card as used to make the Deposit. It is your responsibility to advise us if we should use a different card and to contact us using the details on our Contact Us page to arrange an alternative payment method. If the Balance Payment is rejected for any reason, the Park will contact you to attempt to make alternative Payment arrangements. The Park may cancel your Booking if they have not received your Balance Payment by the due date.
Deposit payments are subject to a £5 minimum and are non-refundable. We are not liable for any refunds in the event of changes to your booking (made by you or the Park), overbooking by the Park, Force Majeure (defined below) or any other cause beyond our control.
If you request extra facilities or services ("Request") in the process of your Booking they will be subject to the Park's availability. The Company will have no liability to you in the event that the Park is unable to meet any such Request.
Please ensure that you check the dates, price, Park's location and other details provided on the Website before proceeding with your Booking.
We do not charge you any booking fees or add any fees to the prices quoted by the Park for your Booking. The rate parity agreements we have with Parks include a commitment from them that you won't pay any more than you would if booking direct. We help Parks to grow their booking revenue by reaching a larger audience and they pay us a marketing fee for our services.
BOOKING AMENDMENTS AND CANCELLATIONS
Booking amendments or cancellations can only be accepted in accordance with the terms and conditions of the Park, who may charge a cancellation or alteration fee.
Any cancellation or amendment request should be addressed directly to the Park using the contact details provided in your Confirmation. We recommend that you have received written confirmation of any changes to your Booking prior to travel.
The Park are not liable for refunds or expenses you incur in the event they are prevented from fulfilling your Booking as a result of circumstances beyond their control. Such circumstances shall include (but not be limited to) war, terrorism, riots or civil unrest, industrial action, flooding, natural disaster, epidemics, health risks or such similar events ("Force Majeure"). We recommend that you have adequate holiday insurance in place to cover this.
If you expect to have a late or delayed arrival, please take the courtesy to communicate with the Park so that they can make any necessary arrangements to receive you.
ADDITIONAL TERMS
Bookings for single sex groups (e.g. stag or hen parties) may not be acceptable to all Parks and you are advised to confirm with the Park beforehand that they are prepared to accept the Booking. If a Booking has been made and in event that a Park does not accept this type of group then the Booking may be cancelled and cancellation fees may apply, according to the Park's policy.

PAYMENT CARD FRAUD
Please report any fraudulent activity on your credit card, charge card or debit card ("Payment Card") to your card provider or bank in accordance with its reporting rules and procedures immediately and contact us for any assistance using the details on our Contact Us page. In the event of fraudulent or unauthorised use of your Payment Card by third parties the Company cannot accept any liability.
INSURANCE
We are not liable for damages or losses that may result from travel to, or staying in, any destination and it is your responsibility to check that you have adequate insurance cover, including but not limited to the cost of cancellation, personal losses and medical costs.
DATA PROTECTION
For the purposes of data protection legislation for data relating to your Booking ("Personal Data"), the Park is the Data Controller and we are the Data Processor.
We will retain any Personal Data collected on your behalf for no longer than is reasonably required for record keeping, complying with legal obligations and resolving disputes. Any Personal Data we have identified as sensitive will be encrypted prior to storage.
We become a Data Controller only where you have given your consent to receive marketing and other communications (together "Communications") from us and only in relation to those Communications.
LIMITATION OF LIABILITY
In no event shall the Company and its equity holders, officers, directors, agents and/or employees be liable for any costs, loss of profits, loss of contract or any indirect, consequential, special or incidental losses, data loss or corruption or punitive damages arising out of, based on, or resulting from the Website, your use of the Booking services, even if the Company has been advised of the possibility of such damages.
These limitations and exclusions apply without regard to whether the damages arise from breach of contract, negligence or any other cause of action. If you are dissatisfied with the Website or Booking service or you do not agree with any part of these Terms, then your sole and exclusive remedy against the Company is to discontinue using the Website.
Subject to the limitations set out in these Terms and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your Deposit and Balance Payment (where collection is initiated by us).
If any part of these Terms limiting or excluding liability is held by a court to be unreasonable or inapplicable, the other parts shall continue to apply.
Nothing in these Terms shall exclude or restrict the Company's liability for death or personal injury resulting from its negligence; nor for the Company's fraud or fraudulent misrepresentation.
